1. Definitions

In these Terms and Conditions:

• "Foxhaven" / "we" / "us" / "our" refers to Foxhaven, an educational provider registered in Malaysia, with premises at 67 Jalan Burmah, 10350 George Town, Pulau Pinang.
• "User" / "you" refers to any individual who uses our website or registers for a programme.
• "Programme" refers to any educational session, workshop, or cohort offered by Foxhaven.
• "Website" refers to the site accessible at https://foxhaven.pro and all pages therein.
• "Agreement" refers to these Terms and Conditions, which form a binding agreement between you and Foxhaven.

2. Acceptance of Terms

By using this Website or registering for a Programme, you confirm that you are at least 18 years of age, have the legal capacity to enter into this Agreement, and agree to be bound by these Terms and Conditions. If you do not agree, you should not use the Website or register for any Programme.

3. Description of Services

Foxhaven provides educational programmes focused on side-income concepts for adults aged 40 and above in Malaysia. Our programmes are educational in nature and do not constitute professional advice of any kind, including tax advice, legal advice, or financial advice. Foxhaven is not a licensed professional services firm.

Where participants have questions that fall outside the educational scope of our programmes — such as specific tax compliance queries, legal obligations, or financial planning — we direct them to the appropriate licensed professionals and relevant Malaysian authorities such as the Companies Commission of Malaysia (SSM) and the Inland Revenue Board (LHDN).

4. Programme Enrolment

Enrolment in a Foxhaven programme is confirmed upon receipt of full payment. Places are limited and are allocated on a first-confirmed basis. Enquiries submitted via the website contact form do not constitute a booking; a booking is only confirmed when payment has been received and a confirmation has been issued by Foxhaven.

We reserve the right to decline an enrolment at our discretion, in which case any payment received will be refunded in full.

5. Payment Terms

• All fees are stated in Malaysian Ringgit (RM) and are inclusive of any applicable taxes unless stated otherwise.
• Payment in full is required to secure a place in a programme.
• Accepted payment methods will be communicated upon enquiry.
• We do not store payment card information. Payments may be processed through third-party payment service providers.

6. Cancellations and Refunds

• Cancellations made more than 14 calendar days before the programme start date are eligible for a full refund, less any reasonable administrative fee.
• Cancellations made within 14 calendar days of the programme start date are not eligible for a refund. A transfer to a future programme run may be offered at Foxhaven's discretion.
• If Foxhaven cancels a programme, registered participants will receive a full refund of fees paid.
• Foxhaven reserves the right to reschedule a programme due to circumstances beyond its reasonable control. In such cases, participants will be offered their enrolled place in the rescheduled run or a full refund.

7. User Conduct

By attending a programme or using the Website, you agree to:

• Conduct yourself respectfully toward facilitators and other participants.
• Not record, distribute, or reproduce programme materials without our written consent.
• Not use the Website in any way that is unlawful, harmful, or disruptive.
• Provide accurate information when registering.

8. Intellectual Property

All programme materials, workbooks, readers, website content, and other resources produced by Foxhaven are our intellectual property or are used with appropriate permission. Participants are granted a personal, non-commercial licence to use printed materials for their own reference. Materials may not be reproduced, distributed, or used for commercial purposes without our prior written consent.

9. Educational Scope — Disclaimer

Foxhaven's programmes are educational and informational only. Nothing in our programmes or on our Website constitutes tax, legal, financial, accounting, or other regulated professional advice. You should not rely on programme content as a substitute for independent professional advice appropriate to your specific circumstances. Foxhaven expressly disclaims liability for any decisions made on the basis of programme content without independent professional advice.

10. Limitation of Liability

To the fullest extent permitted by Malaysian law, Foxhaven shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of the Website or attendance at a programme. Our total liability to you in connection with these Terms shall not exceed the fee paid by you for the specific programme in question.

11. Indemnification

You agree to indemnify Foxhaven and its facilitators against any claims, losses, or damages arising from your breach of these Terms or your misconduct during a programme or on the Website.

12. Termination

Foxhaven reserves the right to remove a participant from a programme without refund if their conduct is disruptive, disrespectful, or in breach of these Terms. We may also suspend or terminate access to the Website at any time without notice.

13. Dispute Resolution and Governing Law

These Terms are governed by the laws of Malaysia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia. In the event of a dispute, we encourage parties to first attempt resolution through direct communication before commencing formal proceedings.

14. General Provisions

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
• Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Foxhaven.
• Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of our right to do so in the future.
• Assignment: You may not assign your rights under these Terms. Foxhaven may assign its obligations in connection with a restructuring or change of ownership.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via a notice on our Website. Continued use of the Website or attendance at a programme after such changes constitutes acceptance of the updated Terms.
